Terms and Conditions for Repit Fitness AB

1. Introduction
These Terms and Conditions ("Terms") govern your use of the application "Repit Fitness" and its associated services ("the Service"), provided by Repit Fitness AB (Corp. Reg. No. 559519-4357).
By downloading, installing, using the app, or making an in-app purchase, you agree to be bound by these Terms. If you do not agree to the Terms, you may not use the Service.
2. Definitions
The Service: The Repit Fitness app, including both free features and paid Premium Services.
User: You, the natural person using the Service.
Free Service: The version of the Service offered at no cost with limited functionality.
Premium Service: The paid version of the Service that grants access to extended features, content, and AI analytics. The Premium Service is called "Repit Plus".
Subscription Period: The duration (e.g., one month or one year) for which you pay to access the Premium Service.
App Store: Third-party platforms where the Service is distributed and payments are handled, specifically the Apple App Store and Google Play Store.
3. Acceptance of the Terms
By using the Service, you confirm that you have read, understood, and accept these Terms in their entirety. This agreement is binding under Swedish law (Contracts Act 1915:218).
4. Scope of the Service (Freemium Model)
Repit Fitness AB provides the Service according to a "Freemium Model":
4.1 Free Service:
The basic version of the app is free and allows you to log workouts and view basic statistics. We reserve the right to limit features in the free version.
4.2 Premium Service:
To gain access to full functionality, including in-depth AI analytics and personalized recommendations, a paid subscription is required. Details of what is included in Repit Plus are specified in the app at the time of purchase.
4.3 Availability:
We do not guarantee that the Service will always be free from errors or interruptions. Functionality may vary depending on the device and operating system.
5. Subscriptions and Payment
5.1 Third-Party Payment Handling:
All purchases of Premium Services are handled exclusively by the Apple App Store or Google Play Store. Repit Fitness AB does not handle or store your payment card details. Your agreement regarding payment is between you and the respective App Store.
5.2 Automatic Renewal (Auto-renewal):
Your subscription will automatically renew at the end of each Subscription Period (monthly or annually). Payment will be charged to your Apple ID or Google Play account within 24 hours prior to the end of the current period.
By initiating the subscription, you agree that the recurring fee will be charged until you actively cancel it.
5.3 Prices and Price Changes:
Prices are stated in the app, including VAT. We reserve the right to change prices. In the event of price changes for recurring subscriptions, you will be notified in advance (at least 14 days) via the App Store, email, or in-app notifications, and you have the right to cancel the service before the new price takes effect.
5.4 Subscription Cancellation:
You can cancel your subscription at any time.
PLEASE NOTE: Deleting the app or your Repit Fitness account does not cancel your subscription.
How to cancel: You must cancel the subscription through your phone's settings (under "Subscriptions" in Apple ID settings or Google Play Store).
Cancellation must occur at least 24 hours before the next renewal date to avoid being charged.
5.5 Refunds:
Purchases are generally non-refundable. As payment is handled by Apple/Google, any claims for a refund must be directed to them in accordance with their terms and conditions.
6. Free Trials and Discounts
6.1 Trial Period (Free Trial):
We may offer a free trial period (e.g., 14 or 30 days). To start the trial, you are often required to provide a payment method in the App Store.
Important: If you do not cancel the trial period at least 24 hours before it expires, it will automatically convert to a paid subscription, and you will be charged for the next period.
6.2 Discount Codes:
Discount codes and promotions are only valid for the specified period. When a discounted period ends, the subscription automatically renews at the regular price unless cancelled beforehand. Discounts cannot be combined.
7. Right of Withdrawal (Distance Contracts Act)
Under law, consumers normally have a 14-day right of withdrawal for distance sales.
Exception for Digital Content: By purchasing a Premium Service and receiving immediate access to the digital content, you consent to the delivery of the service commencing, and you thereby waive your right of withdrawal.
If you do not consent to immediate commencement, the 14-day right of withdrawal applies, but you will not gain access to the Premium Services until the withdrawal period has expired.
8. User Eligibility
To use the Service, you must be at least 13 years old. To enter into a purchase agreement (Subscription), you must be 18 years old or have permission from a guardian. Repit Fitness AB reserves the right to terminate accounts that do not meet these requirements.
9. Account Registration and Security
You are responsible for keeping your login credentials confidential. All activity that occurs through your account is your responsibility. In case of suspected unauthorized use, you must contact us immediately.
10. Rules of Use
You may not use the Service for illegal purposes, harassment, or to spread malicious code. It is prohibited to attempt to circumvent paywalls or copy the Service's content (Intellectual Property Rights). Violation may lead to immediate suspension and legal action.
11. User-Generated Content
You are responsible for all material (text, image, data) you upload. You may not upload offensive, illegal, or copyrighted material. Repit Fitness AB has the right to remove content that violates these Terms.
12. AI Service and Disclaimer
12.1 For Informational Purposes Only:
Our AI service provides recommendations based on data. These should be viewed as inspiration, not medical advice.
12.2 Health Responsibility:
All training is at your own risk. Repit Fitness AB is not liable for personal injuries, health problems, or damage arising from the use of the Service. Always consult a doctor before starting a new training program.
13. Processing of Personal Data
We value your privacy. Our collection and processing of data are governed by our Privacy Policy (https://www.repitfitness.se/integritetspolicy) and comply with GDPR. Note that Apple and Google are independent data controllers for your payment information.
14. Limitation of Liability
The Service is provided "as is." Repit Fitness AB is not liable for indirect damages, data loss, or financial loss resulting from the use of the Service, unless gross negligence can be demonstrated. Our liability is limited to the amount you paid for the Service during the last 12 months.
15. Changes to the Terms
We may update these Terms. Material changes will be communicated via the app or email. Continued use after a change implies acceptance.
16. Applicable Law and Dispute Resolution
These Terms are governed by Swedish law. Disputes shall primarily be resolved through agreement. If an agreement cannot be reached, the dispute will be settled in a Swedish court. As a consumer, you can also turn to the National Board for Consumer Disputes (ARN).
